Terms of Service
The agreement between you and AppDevs when you use the AppDevs Cloud platform.
This document is a template pending legal review. It describes how the platform is intended to operate, but it is not yet the final, legally binding version.
1. Service description
AppDevs Cloud provides ready-made business software operated as managed cloud instances. Depending on the product, the service is offered as a Cloud subscription (managed by AppDevs), a one-time Source Code license (hosted by you), or an Enterprise engagement (a dedicated managed environment under a separate contract).
Cloud subscriptions include a dedicated application instance, a separate database, a platform cloud address, optional custom domain connection, managed SSL, backups, updates and monitoring as described on the platform pages.
2. Subscriptions & billing
Cloud plans are billed monthly or yearly in advance, per product and per plan, at the prices shown on the relevant product page at the time of purchase. Plan upgrades take effect immediately and are prorated against the current billing period.
You may cancel a subscription at any time; by default, cancellation takes effect at the end of the current billing period. Source Code licenses are one-time payments and are non-recurring. Enterprise engagements are billed according to their individual contract.
3. Data ownership
The business data you store in your instance belongs to you. AppDevs operates the infrastructure the data runs on but claims no ownership of your content, and accesses instance data only to operate, support and secure the service.
On termination, your data is retained according to the platform retention policy and can be exported before deletion. Backups are maintained on schedule with retention windows while your subscription is active.
4. Acceptable use
You may not use the platform to host unlawful content, to send unsolicited bulk communications, to attempt to access other tenants' instances or data, or to interfere with the operation of the platform.
AppDevs may suspend an instance that presents a security risk to the platform or to other customers, and will notify you as soon as reasonably possible when this happens.
5. Liability
The service is provided as described on the platform pages. To the maximum extent permitted by law, AppDevs' aggregate liability arising out of or related to the service is limited to the amounts you paid for the service in the twelve months preceding the claim.
AppDevs is not liable for indirect or consequential damages, or for losses caused by factors outside its reasonable control, including your own infrastructure when running a Source Code license.
